NOTICE TO CREDITORS
ESTATE OF BETTY JO KNIGHT, Deceased Case No. 2024-PR-40
Notice is hereby given that on the 26th day of November, 2024, Letters Testamentary in respect of the estate of Betty Jo Knight, who died on September 21, 2024, were issued to the undersigned by the Chancery Court of Clay County, Tennessee.
All persons, resident and non-resident, having claims matured or unmatured against the Estate are required to file same with the Clerk of the above named court on or before the earlier of the dates prescribed in (1) or (2), otherwise their claims will be forever barred.
(1) (a) Four (4) months from the date of the first publication (or posting, as the case may be) of this notice if the creditor received an actual copy of this notice to creditors at least sixty (60) days before the date that is four (4) months from the date of the first publication (or posting);
(b) Sixty (60) days from the date the creditor received an actual copy of this notice to creditors if the creditor received the copy of the notice less than sixty (60) days prior to the date that is four (4) months from the date of first publication (or posting) as described in (1)(a); or
(2) Twelve (12) months from the decedents date of death. This 26th day of November, 2024.

NOTICE OF TRUSTEE’S SALE
Default having been made in the terms, conditions, and payments provided for in that certain Deed of Trust registered June 5, 2014, of record in Book TD133, Page 647, Register’s Office for Clay County, Tennessee, as modified by Deed of Trust Modification and Extension Agreement registered of record in Book TD152, Page 499, Register’s Office for Clay County, Tennessee (hereafter collectively “Deed of Trust”) from or executed by Lydia Chilton (“Borrower”) to Marty Maynord, Trustee, securing the indebtedness therein described, which indebtedness is now due and unpaid, and has been declared in default by Citizens Bank of Lafayette (Tennessee), Qualified Survivor following merger with American Bank & Trust of the Cumberlands, pursuant to Acknowledgment of Merger registered pursuant to T.C.A. 45-2-1306(b) in Record Book 275, Pages 485-491, Register’s Office Overton County, Tennessee, and Record Book 168, Pages 380-385, Register’s Office Macon County, Tennessee, the lawful owner and holder thereof; and,
Beneficiary has appointed the substitute trustee prior to the first notice of publication as required by T.C.A. § 35-5-101 and ratifies and confirms all actions taken by the substitute trustee subsequent to the date of substitution and prior to the recording of this substitution.
NOW, WHEREFORE, I, William D. Birdwell, Esq., Successor Trustee, pursuant to said Deed of Trust, having been requested by Citizens Bank of Lafayette (Tennessee), Qualified Survivor following merger with American Bank & Trust of the Cumberlands, the owner and holder of said indebtedness so to do, and by virtue of the authority and power vested in me by said Deed of Trust will, on December 30, 2024, at 12:00 p.m., at the South Door of the Clay County Courthouse in Celina, County of Clay, Tennessee, located at 100 Court House Square, Celina, Tennessee 38551, sell at public outcry to the highest bidder for cash (or credit upon the indebtedness secured if the lawful owner and holder thereof is the successful purchaser), the following-described property located in the Fourth (4th) Civil District of Clay County, Tennessee, which, pursuant to TCA 35-5-104(2) has a Concise Description as described in the complete legal description of the property contained in Deed of Trust recorded in Book TD133, Page 647, Register’s Office Clay County, Tennessee, and Common Description of 1394 Pleasant Hill Road, Allons, Tennessee 38541, and Control Map 059, Group –; Parcel 019.00, as assessed by the Assessor of Property, Clay County, Tennessee.
Lien or claim of lien by the United States Internal Revenue Service was not registered in the Register’s Office of the County in which the land is located more than 30 days prior to the sale date;
Lien or claim of lien by the State of Tennessee, Tax Enforcement Division, was not registered in the Register’s Office of the County in which the land is located more than 30 days prior to the sale date;
This sale is being sold subject to any liens, easements, encumbrances, property taxes, rights of redemption of taxing entities and other matters which are prior in right to the lien of the aforesaid Deed of Trust.

Pursuant to TCA 35-5-101(e), a copy of the above notice, as required in TCA 35-5-104, was served upon the above referenced Debtor(s) and Interested Parties, by lodging same with the US Mail Certified Mail, Return Receipt Requested, postage prepaid, for delivery to the addresses indicated on or before the first date of publication.
Pursuant to the Service Members Civil Relief Act of 2003, confirmation was obtained on November 12, 2024, that there is no information in the Department of Defense data center that indicates Lydia Chilton is currently on active military duty.
Dates of Publication; TCA 35-5-101(a)(b): The Dale Hollow Horizon newspaper, a newspaper published in Clay County, Tennessee, the county where the land is located and the sale is to be made, which shall be published in the newspaper on the following dates: December 4, 2024; December 11, 2024; and, December 18, 2024.
The purchase price is due and payable, in full, at the conclusion of the Trustee sale in the form of a cashier’s check endorsed to the order of William D. Birdwell Escrow. Personal checks shall not be accepted. For any amount the cashier’s check exceeds the purchase price, the Trustee shall refund said excess payment to the purchaser following the deposit of the cashier’s check into his trust account.
This sale is being sold subject to any tenants in possession of the property.
The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
Pursuant to TCA 35-5-101(f) the Successor Trustee may adjourn the day of the sale to another day, time, and place.
The Successor Trustee is attempting to collect a debt. Any information obtained shall be used for that purpose.
