Public Notice of Regular Meeting of the Board of Commissioners of North West Clay Utility District of Clay County, Tennessee
NOTICE IS HEREBY GIVEN to all members of the Board of Commissioners of North West Clay Utility District of Clay County, Tennessee (the “District”) and all residents of said District and to all persons interested, that an open public and regular meeting of the Board of Commissioners of the District will be held at the District’s offices, Celina Tennessee at 5:00 p.m., local time, on January 12, 2011, for the purpose of considering all matters as may be properly presented to it, including without limitation the consideration of a bond resolution authorizing the issuance of a $1,704,000 Waterworks Revenue Bond, Series 2011, the proceeds of which will be used to finance the construction of improvements and extensions to the District’s waterworks system.
This notice is given pursuant to the provisions of Sections 8-44-101 to 8-44-106, inclusive, Tennessee Code Annotated.

NOTICE OF SALE
WHEREAS, by Deed of Trust dated July 12,2007, of record at Trust Deed Book 108, pages 293-
301, Register’s Office of Clay County, Tennessee, Polly Lou Netherton, conveyed in trust to Fred R.
Lawson, Trustee, that property hereinafter described to secure the payment of a certain promissory note; and
WHEREAS, Citizens Bank of Lafayette is presently the owner and holder of said Promissory Note
and Deed of Trust above referred to, securing the indebtedness therein mentioned; and
WHEREAS, default has occurred under the terms of the Promissory Note and the Deed of Trust,
thereby necessitating foreclosure, and Citizens Bank of Lafayette, has directed James D. White, Jr., as
Substitute Trustee, to immediately commence foreclosure on the subject property;
NOW THEREFORE this Trustee’s Notice of Sale, default having occurred in the payment of the
Promissory Note according to the terms and conditions thereof, and the Promissory Note being in default,
the undersigned, James D. White, Jr., Substitute Trustee, does hereby give notice that he, as attorney, andlor
agent, will sell the hereinafter described property on January 13,201 1, at the hour of 1 :00 p.m., at the South
door of the Courthouse in Celina, Clay County, Tennessee, to the last, highest and best bidder, for cash in
hand and free from the rights of redemption, homestead, and dower, and all other exemptions of any kind,
but subject to any delinquent or current real property taxes on the property, and any valid mineral andlor oil
and gas leases. The property to be sold is described as follows, lying and being in the 2nd Civil District of
Clay County, Tennessee, and more particularly described as follows, to-wit:
The Divisional Line Beginning on a rock on the East Bank of Trace Creek and in the line
of Ray Bean; thence running a straight line Eastward to marked mulberry tree; thence
running Southeastward and curving around the hill side a marked line to marked elm at or
near the line of Ray Bean. This line being marked by other the parties hereto.
Vola Lee Huff conveyed all her right and interest to the lands lying on the South side of the
divisional line unto Polly Lou Keith by warranty deed dated October 7, 1961, and recorded
in Deed Book 15, page 60, Register’s Office of Clay County, Tennessee.
There is also granted and given in this conveyance the right for Vola Lee Huff to have a
road way andlor right of way over and across the South side of these lands conveyed to
Polly Lou Keith for free ingress, and egress, and Vola Lee Huff does hereby grant and give
unto Polly Lou Keith the right to use the spring for water which lies on the North side of
said divisional line.
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any
restrictive covenants; easements, or set back lines that may be applicable; any statutory rights or redemption
of any Governmental Agency, State or Federal; any prior liens or encumbrances as well as any priority
created by fixture filing; to any matter that an accurate survey of the premises might disclose; and subject
to, but not limited to the following parties who may claim an interest in the above referenced property; Polly
Lou Netherton and Citizens Bank of Lafayette and subject to any party who may claim an interest in the
above referenced property.
The sale held pursuant to this notice may be rescheduled at the Trustee’s option at any
time.

NOTICE TO CREDITORS
Notice is hereby given that on the 16th day of December, 2010, Letters of
Administration in respect of the estate of Herman C. Collins, who died on September 25,
2010, were issued to the undersigned by the Chancery Court of Clay County, Tennessee.
All persons resident and non-residents having claims matured or unrnatured against the
Estate are required to file same with the Clerk of the above court at the Clay County
Courthouse, 100 Courthouse Square, P.O. Box 332, Celina, Tennessee, within the earlier
of four (4) months of this notice or (12) months from the decedent’s death, otherwise
their claims will be forever barred.
