NOTICE OF EXPLANATION
The City of Celina, Tennessee, intends to rehabilitate portions of its water system through a Community Development Block Grant Program. The project is needed in order to reduce the excessive water loss problem the system is experiencing. Portions of the project are in the 100-year floodplain. There is no practical alternative to the proposed project as designed to rehabilitate the water system. The proposed project conforms to all applicable State floodplain protection standards. Standard construction and engineering practices will be utilized to ensure that there will be no impeding of stream flow, and flood levels will not increase as a result of the project. Minimization efforts will be taken to disturb the landscape as little as possible and stream banks will be restored to their natural state after the lines are replaced. Therefore, the project will not affect natural or beneficial floodplain values. Failure to provide these improvements would result in the continued water loss currently experienced by the water system. The other agency involved in this project is the State of Tennessee with funds from the U.S. Department of Housing and Urban Development and local matching funds through the City of Celina.

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Celina.
REQUEST FOR RELEASE OF FUNDS
On or about January 21, 2011, the City of Celina will submit a request to the Department of Economic and Community Development for the release of Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project known as the City of Celina FY 2010 CDBG Water System Rehabilitation Project, for the purpose of rehabilitating water lines in the City of Celina. The project funding is estimated to be $550,000.00 with $500,000.00 coming from CDBG funding. The project location includes portions of the service area of the City of Celina Water Distribution System located in the City of Celina, as well as rural Clay County.
FINDING OF NO SIGNIFICANT IMPACT
The City of Celina has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Mayor’s Office, Celina City Hall, 143 Cordell Hull Drive, Celina, TN and may be examined or copied weekdays 8:00 a.m. to 4:00 p.m.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the City of Celina, Willie P. Kerr, Mayor, P. O. Box 449, Celina, TN 38551. All comments received by January 20, 2011, will be considered by the City of Celina prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of Celina certifies to the Tennessee Department of Economic and Community Development that Willie P. Kerr in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Tennessee Department of Economic and Community Development (ECD) approval of the certification satisfies its responsibilities under NEPA and related laws and authorities.
OBJECTIONS TO RELEASE OF FUNDS
The Tennessee Department of Economic and Community Development will accept objections to its release of funds and the City of Celina certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following basis:
The certification was not executed by the Certifying Officer of the City of Celina;
The City of Celina has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58;
The grant recipient has committed funds or incurred costs not authorized by 24CFR Part 58 before approval of a release of funds by the Tennessee Department of Economic and Community Development; or
Another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
Objections must be prepared and submitted in accordance with the required procedures (24CFR Part 58) and shall be addressed to the State of Tennessee, Department of Economic and Community Development, Program Management, William R. Snodgrass Tennessee Tower, 10th Floor, 312 Eighth Avenue North, Nashville, Tennessee 37243-0405. Potential objectors should contact the Program Management Office to verify the actual last day of the objection period.

PUBLIC NOTICE
The Clay County E911 Board will be assigning a road name to the following location: Hwy 53 North( Burkesville Hwy), right on Holly Creek Rd, right on Red Oak Ridge Rd, left on unnamed road.
Any interested resident and/or property owner will need to submit a request, at the E911 Board Meeting, January 17, 2011 at 6:30 pm at the Clay County Board of Education ( Board Room).

NOTICE OF SALE
WHEREAS, by Deed of Trust dated July 12,2007, of record at Trust Deed Book 108, pages 293-
301, Register’s Office of Clay County, Tennessee, Polly Lou Netherton, conveyed in trust to Fred R.
Lawson, Trustee, that property hereinafter described to secure the payment of a certain promissory note; and
WHEREAS, Citizens Bank of Lafayette is presently the owner and holder of said Promissory Note
and Deed of Trust above referred to, securing the indebtedness therein mentioned; and
WHEREAS, default has occurred under the terms of the Promissory Note and the Deed of Trust,
thereby necessitating foreclosure, and Citizens Bank of Lafayette, has directed James D. White, Jr., as

in Deed Book 15, page 60, Register’s Office of Clay County, Tennessee.
There is also granted and given in this conveyance the right for Vola Lee Huff to have a
road way and/or right of way over and across the South side of these lands conveyed to
Polly Lou Keith for free ingress, and egress, and Vola Lee Huff does hereby grant and give
unto Polly Lou Keith the right to use the spring for water which lies on the North side of
said divisional line.
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any
restrictive covenants; easements, or set back lines that may be applicable; any statutory rights or redemption
of any Governmental Agency, State or Federal; any prior liens or encumbrances as well as any priority
created by fixture filing; to any matter that an accurate survey of the premises might disclose; and subject
to, but not limited to the following parties who may claim an interest in the above referenced property; Polly
Lou Netherton and Citizens Bank of Lafayette and subject to any party who may claim an interest in the
above referenced property.
The sale held pursuant to this notice may be rescheduled at the Trustee’s option at any
