NOTICE OF SALE WHEREAS, by Deed of Trust dated May 17,2010, of record at Trust Deed Book 119, pages 556-559, Register’s Office of Clay County, Tennessee, Melissa Webb and Chris Brown, conveyed in trust to Michael I<. Bailey, that property hereinafter described to secure the payment of a certain promissory note; and WHEREAS, Bank of Celina, Branch of Citizens Bank of Lafayette, is presently the owner and holder of said Promissory Note and Deed of Trust above referred to, securing the indebtedness therein mentioned; and WHEREAS, default has occurred under the terms of the Promissory Note and the Deed of Trust, thereby necessitating foreclosure, and Bank of Celina, Branch of Citizens Bank of Lafayette, has directed Michael K. Bailey, as Trustee, to immediately commence foreclosure on the subject property; NOW THEREFORE this Trustee’s Notice of Sale, default having occurred in the payment of the Promissory Note according to the terms and conditions thereof, and the Promissory Note being in default, the undersigned, Michael K. The property to be sold is described as follows, lying and being in the 1st Civil District of Clay Comity, Tennessee, and more particularly described as follows, to-wit: Tract No. 1 : Being Tract No. 17 of the Henry Boyd Stone Farm property as of record in Plat Book 1, page 96, Register’s Office of Clay County, Tennessee, to which reference is hereby made for a more complete and accurate legal description. Restrictions of record in Deed Book 73, page 134, Register’s Office of Clay County, Tennessee. There is a 20 ft. utilities easement retained along the front of tracts 2 through 9 and 13 through 48 as they adjoin Henry Boyd Stone Lane and 3 tracts, 10, 11 and 12 as they adjoin Arcot Road. Henry Boyd Stone Lane is a 50 ft. wide no11 exclusive easement. All tracts that adjoin said lane to the center of the land. All those who adjoin it agree to dedicate the said 50 ft. if the county agrees to take the lane overs as a county road. As of this date, the lane is not a county road and maintenance of the land is the responsibility of those that adjoin it. Utilities can be laid 011 either side of this 50 ft. non exclusive easement. This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants; easements, or set back lines that may be applicable; any statutory rights or redemption of any Governmental Agency, State or Federal; any prior liens or encumbrances as well as any priority created by fixture filing; to any matter that an accurate survey of the premises might disclose; and subject to, but not limited to the following parties who may claim an interest in the above referenced property; Melissa Webb, Chris Brown and Bank of Celina, Branch of Citizens Bank of Lafayette, and subject to any party who may claim an interest in the above referenced property.
