NOTICE OF TRUSTEE’S SALE
Default having been made in the terms, conditions, and payments provided for in that certain Deed of
Trust registered on November 7, 2023, in Book TD 176, page 723, Register’s Office for Clay County,
Tennessee (hereafter “Deed of Trust”), from or executed by Drew Lee Smith (hereafter “Borrower”) to
Bruce Elder, Trustee, securing the indebtedness therein described, which indebtedness is now due and
unpaid, and has been declared in default by Peoples Bank & Trust Co. (a/k/a People’s Bank & Trust Co
of Pickett County), the lawful owner and holder thereof (hereafter “Bank”); and,
The undersigned, William D. Birdwell, Esq., Successor Trustee, having been appointed through
Appointment of Successor Trustee, recorded in Book MS 19, Pages 104-106, Register’s Office for Clay
County, Tennessee;
NOW, WHEREFORE, I, William D. Birdwell, Esq., Successor Trustee, pursuant to said Deed of Trust,
having been requested by said Bank so to do, and by virtue of the authority and power vested in me by
said Deed of Trust will, on December 12, 2025 at 12:00 p.m., at the South Door of the Historic Clay County
Courthouse, located at 100 Court House Square, Celina, Clay County, Tennessee 38551, sell at public
outcry to the highest bidder for cash (or credit upon the indebtedness secured if the lawful owner and
holder thereof is the successful purchaser), the following-described property located in Clay County,
Tennessee, which, pursuant to TCA 35-5-104(2) has a Concise Description as described in the complete
legal description of the property contained in the Deed of Trust recorded in Book TD 176, Page 723,
Register’s Office for Clay County, Tennessee, and Common Description of 360 Wayne Smith Rd, Celina,
Tennessee 38551, Control Map 020, Parcel 075.07, as assessed by the Assessor of Clay County, Tennessee.
Being a tract or parcel of land lying and being located in Clay County, Tennessee, described as follows:

Beginning at a 1/2″ Rebar (New) set this survey, said Rebar being located in the Southern right-of-way of
Wayne Smith Road, and being the Northeast corner of Jimmie W. & Linda Smith (DB68/P106); Thence,
leaving the Northern line of said Smith and with the terminus of Wayne Smith Road, N 22° 03’20” E,
36.47′ to a 1/2″ Rebar (New) set this survey at a 36″ Black Oak Stump, said Rebar being the Southeast
corner of Forrest & Connie Britt (DB45/P708);Thence, leaving the Northern right-of-way of said Wayne Smith Road and with the land of said Britt for
the following four (4) calls: 1.) N 04°51’59” W, 103.01′ to a Wooden Fence Post; 2.) N 07°46’59” W, 191.49′
to a Wooden Fence Post; 3.) N 88°59’22” W, 153.19′ to a Wooden Fence Post; and 4.) S 07°02’07” E,
140.14′ to al/2″ Rebar (New) set this survey, said Rebar being the Northeast corner of Katheleene Smith

Southeast corner of the herein described tract;
Thence, leaving the Western line of said Boone and with the Eastern line of said Smith for the following
four (4) calls: 1.) S 88°21’14” W, 188.31′ to a Planted Stone (Old); 2.) S 76°05’25” W, 135.31’to a 10″
Hickory Tree; 3.) S 89°27’26” W, 54.23′ to a 1/2″ Rebar (New) set this survey at a 24″ White Oak Tree,
said Rebar being the Southwest corner of the herein described tract; and 4.) N 27°27’38” W, 104.27′ to
the point of beginning, containing 7.97 Acres by Survey. Actual field survey performed under the direct
personal supervision of Wayne E. Shanks, R.L.S. #2818, Whittenburg Land surveying, LLC, 214 East

This sale is being sold subject to liens, easements, encumbrances, property taxes, equitable or statutory
right of redemption, or other matters, if any, which are prior in right to the lien of the Deed of Trust.

Pursuant to TCA 35-5-101(e) and 35-5-104, a copy of this notice was served upon the Borrower and
Interested Parties, by lodging same with the United States Mail, Certified, Return Receipt Requested,
postage prepaid, for delivery to the addresses indicated on or before the first date of publication.
Pursuant to the Service Members Civil Relief Act of 2003, it was confirmed by Successor Trustee that
there is no information in the Department of Defense data center that indicates the Borrower is currently
on active military duty.
Dates of Publication; TCA 35-5-101(a)(1) and (b): The Dale Hollow Horizon, a newspaper published in
Clay County, Tennessee, the county where the land is located and the sale is to be made, which shall be
published in the newspaper on the following dates: November 19, 2025, and November 26, 2025.
Pursuant to TCA 35-5-101(a)(2) and 35-5-104(a)(7), this notice was posted online by www.
foreclosuretennessee.com, a third-party internet posting company, beginning on November 19, 2025, for
at least twenty (20) continuous days.
The purchase price is due and payable, in full, at the conclusion of the Trustee sale in the form of a
cashier’s check paid or endorsed to the order of William D. Birdwell Esq., Escrow. Personal checks shall
not be accepted. For any amount the cashier’s check exceeds the purchase price, the Successor Trustee
shall refund said excess payment to the purchaser following the deposit of the cashier’s check into his
trust account.
This sale is being sold subject to any tenants in possession of the property. The sale held pursuant to this
Notice may be rescinded at the Successor Trustee’s option at any time. Pursuant to TCA 35-5-101(f) the
Successor Trustee may, on the day of the sale, adjourn and reschedule the sale to another day, time, and
place.
The Successor Trustee is attempting to collect a debt. Any information obtained shall be used for that
purpose.
